Com apenas um reconhecimento de paternidade, o município de Jardim lidera o maior índice de pais ausentes no Ceará

A falta do nome do pai nas certidões de nascimento ainda faz parte dessa triste realidade no país em pleno século 21. No Ceará, o município de Jardim, distante 536 quilômetros da capital Fortaleza e localizado na Região Metropolitana do Cariri, com 27.181 habitantes (IBGE, 2020), lidera o maior índice de pais ausentes com 13%. Dos 6.205 nascimentos entre 01/01/2016 e 31/07/2023, 828 crianças foram registradas com o nome da mãe, tendo apenas um reconhecimento de paternidade até agora. Já em Fortaleza, no mesmo período, das 287.111 certidões de nascimentos emitidas pelos cartórios, 18.256 constavam apenas o nome da mãe – ou seja, 6%. Desse total, houve 224 reconhecimentos de paternidade, com pico em março de 2022, de 49 registros.

Os dados fazem parte da Central de Informações do Registro Civil (CRC Nacional) e, ainda sobre o Ceará, mostram que a falta do nome do pai nas certidões de nascimento chega a atingir 10% do total de nascimentos entre 2016 e 2023. Nessa relação, estão os municípios de Catunda, com 651 nascimentos e 67 pais ausentes; Caucaia, com 23.410 nascimentos e 2.250 pais ausentes; Chaval, com 837 nascimentos, 81 pais ausentes; Itaitinga, com 5.146 nascimentos, 526 pais ausentes; Itatira, com 105 nascimentos, 11 pais ausentes; e Missão Velha, com 2.593 nascimentos, 257 pais ausentes. Na contramão desse cenário, está o município de Potengi, que registrou 771 nascimentos e todos com o nome da mãe e do pai na certidão.

Segundo a titular de Registro Civil no município de Granja e diretora de Comunicação da Associação dos Notários e Registradores do Ceará (Anoreg-CE), Priscila Aragão, “o papel dos cartórios vai além de oferecer serviços essenciais como a certidão de nascimento e gratuidade para pessoas que, comprovadamente, não podem pagar. Por meio da associação, encampamos diversas ações e campanhas nos municípios e estamos engajados para receber os pais que desejam colocar o nome na certidão dos seus filhos durante o ano todo. Lembro, ainda, que com o Provimento nº 16/2012, a Corregedoria Nacional de Justiça (CNJ) tornou menos burocrático o reconhecimento tardio espontâneo de paternidade. Desta forma, qualquer cartório de registro civil pode realizar esse ato”. Caso o filho seja menor de idade, a mãe deve acompanhar a solicitação, munida dos documentos originais de ambos e a certidão de nascimento do filho.

No município de Granja, entre 2016 e 2023 foram emitidas 3.596 certidões de nascimento, com 159 constando apenas o nome da mãe. Lá, os pais ausentes representam 4%. Mas ao olhar para o cenário nacional, dos 20.433.027 nascimentos no mesmo período, 1.127.702 crianças ainda não possuem o nome do pai em suas certidões de nascimento. Com o recorte apenas de 2022, 165 mil crianças, ou 7% dos nascimentos no país, faziam parte dessa triste realidade. De uma forma mais global, segundo dados do Conselho Nacional de Justiça (CNJ), são 5,5 milhões de crianças brasileiras sem o registro do pai.

Reconhecimento de Paternidade

O que é?

O reconhecimento da paternidade pode ser solicitado pela mãe da criança, pelo próprio filho maior de 18 anos ou ainda pelo pai que deseja confirmar sua paternidade.

Como é feito?

A mãe ou o filho maior de 18 anos que não tiver o nome do pai em sua certidão deve ir a qualquer cartório de registro civil do país e apontar o suposto pai. Para isso, precisa ter em mãos a certidão de nascimento do filho a ser reconhecido e preencher um formulário padronizado.

Discordância paterna

Caso o genitor discorde do pedido de reconhecimento paterno, o cartório deve encaminhar a solicitação para o juiz da localidade em que o nascimento foi registrado, para dar prosseguimento à ação investigatória conforme a Lei nº 8560 de 1992, que disciplina o processo de apuração das informações fornecidas pela mãe em relação ao suposto pai – a chamada investigação de paternidade oficiosa.

Nesse procedimento, o juiz solicita ao suposto pai que reconheça a paternidade de forma espontânea para realização de acordos.

Caso o suposto pai se negue a assumir a paternidade, ele é chamado em juízo para contestar e fazer o exame de DNA. E caso ocorra a recusa de exame, a jurisprudência é firmada no sentido de reconhecer a paternidade, porque há a presunção em caso de recusa do exame. O cartório é oficiado para o registro do nome do pai e dos avós paternos na certidão da criança e o pai será responsabilizado judicialmente para que cumpra seus deveres.
