O Expedited Removal é um procedimento que permite aos agentes do U.S. Customs and Border Protection (CBP) deportar rapidamente não cidadãos que estejam em situação irregular ou que tenham cometido falsificação ou fraude. Por meio desse processo, determinados não cidadãos podem ser deportados em apenas um dia, sem a necessidade de uma audiência em tribunal de imigração ou perante um juiz.
Sob a política expandida, indivíduos sem documentação, que entraram nos EUA sem inspeção e que não conseguem comprovar que residem no país há mais de dois anos poderão estar sujeitos a remoção expedita. As novas diretrizes entraram em vigor imediatamente, mas foram contestadas por defensores dos direitos dos imigrantes nos tribunais.
O advogado, especialista em imigração legal, Dr. Vinicius Bicalho, explica que pessoas com o direito legal de estar nos EUA, incluindo cidadãos americanos, residentes permanentes legais (LPRs), portadores de vistos válidos e não expirados, refugiados admitidos ou solicitantes de asilo, não estão sujeitos à remoção expedita, assim como menores desacompanhados.
“As diretrizes não se aplicam àqueles que foram admitidos ou parolados nos EUA, como pessoas que excederam o prazo de seus visto”, afirma.
Bicalho também pontua algumas recomendações que podem ajudar independentemente da situação migratória. “Todos os imigrantes e membros da comunidade devem estar cientes de como responder à expansão da remoção expedita. Indivíduos sem documentação, assim como cidadãos americanos e residentes legais, enfrentam um risco maior de prisão e deportação sem o devido processo legal”, destaca.
Confira algumas recomendações:
* Você tem o direito de permanecer em silêncio. Isso se aplica em casa, no trabalho ou em qualquer outro lugar. Se for abordado por um agente de imigração, não precisa dizer seu nome, local de nascimento ou situação migratória.
* Você tem o direito de falar com um advogado antes de responder a qualquer pergunta. Não é obrigado a responder perguntas sem a presença de um advogado, mesmo que esteja legalmente nos EUA. Se for detido, pode ser necessário fornecer seu nome para que sua família ou advogado possa localizá-lo.
* Você não precisa abrir a porta da sua casa sem um mandado judicial.Você tem o direito de recusar a entrada de agentes de imigração na sua casa, a menos que apresentem um mandado de busca oficial emitido por um tribunal e assinado por um juiz.
* Você tem o direito de solicitar a exibição do mandado. Pode pedir ao agente que deslize o mandado por baixo da porta para verificar. Se for um mandado assinado por um juiz e com o seu endereço, deve permitir a entrada dos agentes. Caso contrário, você pode sair e fechar a porta, evitando que questionem outras pessoas na residência.
* Você não precisa assinar documentos sem falar com um advogado. Não permita que agentes de imigração o pressionem a assinar documentos, mesmo que ameacem detê-lo ou deportá-lo.
* Você não precisa “mostrar seus documentos”. Pode simplesmente informar ao agente que deseja falar com um advogado. No entanto, apresentar documentos que comprovem sua cidadania, status legal ou residência nos EUA por dois anos pode acelerar sua liberação.
* Se for detido, você tem o direito de entrar em contato com o consulado do seu país de origem. Também tem o direito de falar com um advogado.
* Nunca minta sobre seu status migratório nem apresente documentos falsos. Isso pode resultar na proibição vitalícia de reentrada nos EUA e outras consequências negativas.
O que fazer?
* Se você possui status legal, não está sujeito à remoção expedita. Se for cidadão americano, residente permanente legal ou detentor de status legal (por exemplo, solicitante de asilo, visto U ou visto T), informe ao agente e apresente documentos de apoio.
* Se você tem medo de perseguição em seu país de origem, tem direito a uma entrevista de medo credível. Se for elegível para asilo, informe ao agente seu medo de retorno e solicite uma entrevista.
* Se você está sem documentos, mas vive nos EUA há mais de dois anos, não está sujeito à remoção expedita. Apresente documentos que comprovem sua permanência de dois anos ou mais. Não é necessário fornecer informações adicionais, como seu status migratório.
* Se você está sem documentos, mas entrou legalmente nos EUA, não está sujeito à remoção expedita. Informe ao agente que entrou legalmente e apresente os documentos apropriados.
* Se você estiver sujeito à remoção expedita, suas opções são limitadas. Procure um advogado e exerça seu direito de permanecer em silêncio.
Documentos
É recomendável organizar os seguintes documentos em um local seguro, acessível e conhecido por familiares em caso de emergência:

* Cidadãos americanos podem apresentar cópias de seus passaportes, certificados de naturalização ou de cidadania. Isso pode ser útil para evitar classificações errôneas em operações de remoção expedita.
